FMLA Cases

Under the federal FMLA, an employee is entitled to 12 weeks of unpaid leave after 12 months of employment. . The employee must have worked at least 1,250 hours in the 12 months preceding the leave. This leave can be used for a number of reasons, including caring for a newborn baby, welcoming an adopted child into your family, nursing a sick family member or recovering from a medical condition.

There are rules about which employers must comply with the FMLA. Private employers must employ more than 50 employees. The FMLA applies to state and federal government employers and primary and secondary schools, regardless of the number of employees.
