Wage and hour law violations including failure to pay overtime
Some typical violations are:
- Not paying some salaried employees overtime.
- All employees must be paid what they have earned, even if they quit or are fired from a position. This includes unpaid vacation and wages, but may not include bonuses, if the bonuses are not scheduled to be paid while the employee is still employed.
- Employees who receive commission are also subject to commission payments after leaving a company.
- All hourly full-time employees are entitled to be paid time and a half for all hours over 40 worked in a workweek.
- If the employer automatically deducts 30 minutes for a lunch break, it must give the employee that time to eat lunch without also requiring some work during that time.
